Terms of Service

By accessing or using the services provided by Eye1 Transportation and its affiliates,
including transportation brokerage, carrier management, freight forwarding, warehousing,
and related technology platforms (the “Service”), you agree to be bound by this Agreement.
If you do not agree with any part of this Agreement, you must not use the Service.

1) Content and Use

You are responsible for all information transmitted through the Service, including shipping instructions, bills of lading, customs documentation, hazardous materials declarations, and related content.

You agree not to use the Service to:

  • Engage in illegal or fraudulent activities.
  • Harass, threaten, or harm any person or entity.
  • Upload or transmit unlawful, harmful, defamatory, obscene, or objectionable content.
  • Introduce viruses, malware, or harmful code.
  • Tender improperly packaged or mislabeled shipments, including undeclared hazardous materials.
  • Bypass agreed rates or interfere with carrier or shipper relationships.

2) Operational Requirements and Compliance

You agree to comply with all applicable federal, state, and local laws and regulations, including but not limited to U.S. DOT, FMCSA, TSA, OSHA, customs, import/export, hazardous materials, and weight/route restrictions.

Carriers represent that they maintain all required authority, insurance, permits, safety ratings, and licenses.
Shippers represent they have the legal right to tender freight and that shipments are properly classified and documented.

3) Cargo, Documentation, and Title

Bills of lading and delivery receipts serve as receipts only and do not modify this Agreement.
Eye1 does not assume title to goods. You are responsible for complete and accurate documentation and for any duties, taxes, fines, or penalties arising from inaccurate information.

4) Service Performance and Transit

Pickup and delivery times are estimates and not guarantees.
Services may be affected by weather, traffic, inspections, capacity constraints, labor disputes, force majeure events, or other circumstances beyond our control.

5) Intellectual Property

The Service, including all software, content, and functionality, is owned or licensed by Eye1 and protected by intellectual property laws.
No content may be reproduced or distributed without written consent.

6) Prohibition of Illegal Activity

You agree to use the Service lawfully and not transmit contraband, counterfeit goods, stolen property, or restricted shipments without full compliance with applicable law.

7) Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, express or implied.
Eye1 does not guarantee error-free, secure, or uninterrupted service.

8) Limitation of Liability

To the maximum extent permitted by law, Eye1 shall not be liable for indirect, incidental, consequential, special, or punitive damages, including lost profits or business interruption.

9) Cargo Claims and Insurance

Unless stated otherwise in writing, Eye1 is not a motor carrier and does not assume carrier liability.
Cargo claims must be filed against the performing carrier.
Customers are responsible for procuring appropriate insurance coverage.

10) Indemnification

You agree to indemnify and hold Eye1 and its affiliates harmless from claims arising from your use of the Service, violation of this Agreement, or shipment-related issues.

11) Governing Law and Venue

This Agreement shall be governed by the laws of your applicable jurisdiction.
Any disputes shall be brought exclusively in courts located within that jurisdiction.

12) Changes to Terms

Eye1 reserves the right to modify these Terms at any time.
Continued use of the Service constitutes acceptance of updated terms.
